Hello,
So the job's been shot, printed and praised. A four page fashion ad that already ran in one national pub and is to run in another shortly. The problem, I still haven't been paid the 2nd half of the invoice (the first half was paid at the shoot). It's been 31 days since the ad went to print and I was promised payment around July 16 then that got pushed to the end of last week. A phone call on Friday July 30 netted an "I'll check with Accounting and get back to you". 5 days later, an email and voicemail (from me to client) I am now getting nothing but wind. Am I being unreasonable in thinking I should be paid by now? The client is pretty big and definitely legit I am quite surprised they are giving me the runaround this way and am still a bit leery about getting tough, I am not ready to alienate or annoy but I am very annoyed right now!
Any tips on how to proceed in a non-aggressive yet effective manner? Please help!

Hi Karen
Simply send them an email with the invoice (.pdf) attached - and say:
Please contact us immediately if you are unable to detach or download your Invoice.

Hi Ashley, thanks. The invoice is based on usage so if they have not gone to press yet with the 2nd round I can in theory stop them since I have not been paid in full. I guess I am still looking for a *nice* way to push them, but it's looking more and more unlikely.

Karen, I have this on my invoice terms section..."License usage rights are transferred upon full payment of this invoice. Failure to make payments voids any license granted and constitutes copyright infringement" There are other things in my terms sections, but this part is pertinent to your problem.
I use Blinkbid, and I started out with their basic T&C's, but added a couple of things.

Hi John this is excellent advice and I wish I'd used it, I will going forward. As it is it does state in the contract that payment is due upon delivery of final product. I am pretty sure that I could take legal action, I guess I am just trying to avoid that. _________________ http://eekphoto.com/ |

I had a similar situation once. A polite but very firm letter took care of it.
It was pointed out that the right to usage was based on payment in full (it was in the paperwork generated by InView) and that usage prior to payment amounted to a breach of contract as well as a copyright violation, and that the client would also be held liable.
The check was cut very quickly at that point. In fact it was delivered by messenger. _________________ James Cook

Dammit, I did not include language like that. And in fact I didn't include a late fee either, I feel so stupid. Basically all my invoice says is that the fees are based on usage/license and payment is due upon delivery. What leg can I stand on? _________________ http://eekphoto.com/ |

You can still send a letter stating that they don't have the right to use the images until they've been paid for. Skirt the issue that you didn't cover yourself with the contract.
Ask if you should send the invoice to their client. Anything suggesting that the client will get involved is going to motivate them. _________________ James Cook

Hey guys, well after my short but strong email today (and voicemail left with accounts payable) I got a very apologetic email and guarantee of payment this Friday. I am holding my breath waiting for that but have learned some very valuable items to include in my contracts going forward. Thanks for all your advice!

Just remember that you have to be in a position to enforce what you put in a contract. Hiring a lawyer and winning a judgement costs and doesn't guarantee you'll ever collect the judgement. |

Sorry guys, my bad! I got paid that following Friday. Honestly waiting for 35 days wasn't the worst scenario it was the unfulfilled promises of a check that really bothered me.
